Terms of use for RecTake

First things first

RecTake is a diary, not a medical device. The app makes no diagnosis, gives no dosage advice, does not warn about interactions and is no substitute for medical or pharmaceutical advice. It records what you tell it — nothing more. The long form is in the disclaimer, which is part of these terms.

Your entries live on your phone, not with us. The privacy policy explains what that means in detail.

1. Who you are contracting with

The provider of the RecTake app, and your counterparty, is:

Apple and Google are not your counterparty. They provide the distribution channel and handle payment. What that means for Apple is in section 12.

2. Scope

These terms govern your use of the RecTake app on iOS and Android, including speech recognition and the account. They apply to the website rectake.de only where it offers features that require an account.

By installing and using the app you accept these terms. If you do not want to, do not use the app.

3. What you get

We grant you a simple, non-exclusive, non-transferable right to use RecTake on the devices associated with your Apple or Google account, for your own private use.

Not granted: the right to resell, rent out, lend, bundle into another product, or make the app available to third parties for a fee.

4. Account and minimum age

You do not need an account to type entries. Speech recognition does not need one either — it runs in your phone’s operating system. You do need an account for the subscription: it records that you are unlocked, so your subscription is recognised again on a new phone. The reason is in the privacy policy, section 2.3.

You are responsible for keeping your credentials to yourself. If you notice someone else using your account, tell us.

An account belongs to one person. Sharing or passing on accounts is not provided for.

Minimum age: 16. This matches section 12 of the privacy policy and the age ratings in both stores.

5. Subscription, prices, cancellation

Paid features are sold as a subscription through the App Store or Google Play. It follows that:

  • The purchase contract for the subscription is with the store, not with us. All we learn from there is whether a purchase is valid.
  • Prices, taxes and currency are shown by the store before you buy. What it says there applies.
  • A subscription renews automatically until you cancel it. You cancel in the subscription settings of your Apple or Google account — not with us and not in the app.
  • Refunds go through the store under its own terms.
  • Deleting your RecTake account does not cancel a subscription. Cancel first, then delete — see delete account.

No allowance: speech recognition comes with no allowance of recording time. Recording time is no longer counted, and buying additional recording time is no longer provided for. Recognition runs in your phone’s operating system. The subscription unlocks the paid features; without a subscription, reading, searching and exporting stay open.

Right of withdrawal: if you are a consumer, the store informs you about your right of withdrawal before you buy. For digital content it expires once delivery begins with your express consent and your acknowledgement that you thereby lose the right of withdrawal (§ 356(5) of the German Civil Code). Handling, including any refund, follows the store’s terms.

6. Your entries are yours

What you record in RecTake stays yours. We acquire no rights in it, we do not analyse it, and we cannot see it: entries live in a database on your device and are never transmitted to us.

There is an uncomfortable consequence: we have no copy. If the device is lost or the app is deleted, the entries are gone and we cannot restore them. Anyone who wants a backup has to make it themselves.

7. What is not allowed

You may not:

  • use the account and the subscription check for anything other than your own diary — in particular not call them automatically or in bulk, and not build them into another product;
  • extract, pass on or circumvent credentials, tokens or keys;
  • circumvent security measures, the subscription unlock or the sign-in;
  • record other people without their knowledge and agreement;
  • reverse engineer, decompile or modify the app, except where the law expressly permits it.

If an account is used that way, we may suspend the unlock for it. Before blocking an account entirely we say why — unless there is no other way.

8. Availability and changes

We do not promise an uptime percentage. Speech recognition depends on the recognition built into your operating system. If your device cannot provide it itself and without a network, RecTake has no speech recognition — then you type. We do not warrant that every device can do it; this mainly affects Android devices older than version 13. There is deliberately no fallback to a server.

We may develop the app further, change features and discontinue individual ones. If a paid feature goes away permanently, we say so in good time and in text form.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.

For ordinary negligence we are liable only for breach of an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely (a cardinal obligation), limited in amount to the foreseeable damage typical for this type of contract.

Liability is otherwise excluded.

Expressly not covered: we are not liable for decisions about taking, dosing or discontinuing supplements or medication that someone makes on the basis of what RecTake has recorded. Those decisions belong with a doctor or a pharmacist. See the disclaimer.

10. Termination

You can stop at any time: delete the app, delete the account, done. How is described under delete account. A running subscription is cancelled separately, in the store.

We may terminate for good cause, in particular for serious breaches of section 7.

11. Governing law

German law applies. If you are a consumer, the mandatory consumer protection provisions of your country of residence remain unaffected.

Dispute resolution: we are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

12. Additional terms for use via the App Store

Apple requires these terms. They apply only if you obtained RecTake through the App Store, and prevail over the other sections in case of conflict:

  • These terms are concluded between you and us, not with Apple. We alone are responsible for the app and its content.
  • Apple has no obligation to furnish maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price if applicable. To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims are directed at us.
  • We, not Apple, are responsible for addressing claims relating to the app — product liability, failure to conform to legal requirements, and consumer protection claims.
  • If a third party claims that the app infringes its intellectual property rights, we are responsible for the defence of that claim.
  • You represent that you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country, and that you are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
  • We answer questions about the app at support@rectake.de, see support.

13. Changes to these terms

We may change these terms where that is necessary for legal or technical reasons or because the app changes. We announce material changes at least 30 days in advance, in the app or by email to the address on your account. If you do not object before they take effect, they are deemed accepted; we point this out separately in the announcement. You may cancel at any time.

14. Final provisions

If a provision is invalid, the rest of the contract remains in force.
